These Terms of Service (“Terms”) govern your use of the Agent Choice Internet (“ACI,” “we,” “us”) website and managed internet service provided by FollowThrough Works LLC. By using the site or signing up for service, you agree to these Terms. A separate Service Agreement signed at the time of install governs the specifics of equipment, pricing, term, and SLA, and controls in the event of any conflict with these Terms.

Who we are

ACI is operated by FollowThrough Works LLC. We are an independent managed-network provider. We are not affiliated with, endorsed by, or sponsored by State Farm Mutual Automobile Insurance Company.

Use of the website

You may use this website for lawful purposes only. You agree not to: (a) interfere with or disrupt the site or its security; (b) attempt to access data not intended for you; (c) misrepresent your identity or affiliation; or (d) use the site to send unsolicited commercial messages.

Quotes and pricing tool

Prices shown in our pricing tool and quotes are estimates based on the information you provide and current vendor pricing. Final pricing depends on a site survey and the signed Service Agreement. Prices are subject to change without notice until a Service Agreement is signed.

The managed service

ACI provides hardware, installation, configuration, monitoring, and support of an office network. Equipment is leased to you for the duration of the service unless otherwise stated in your Service Agreement. We are responsible for managing the network; you are responsible for the physical security of equipment on your premises and for the activities conducted on your network.

Underlying internet circuits are provided by third-party carriers. Carrier outages, weather, power loss, and acts beyond our reasonable control are not our responsibility, though we will work with carriers on your behalf to restore service.

Billing

Monthly service fees and any one-time setup charges are billed as set out in your Service Agreement. Past-due amounts may incur late fees and may result in suspension of service after notice.

Intellectual property

The ACI name, logos, site content, pricing tool, and documentation are owned by FollowThrough Works LLC and protected by intellectual-property laws. You may not copy, redistribute, or create derivative works without our written permission, except as permitted by law.

Disclaimers

The website and service are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website or service will be uninterrupted, error-free, or completely secure.

Limitation of liability

To the maximum extent permitted by law, FollowThrough Works LLC, its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business interruption, arising out of or related to the website or service. Our total aggregate liability for any claim arising out of the service is limited to the amounts paid by you to us for the service during the three months immediately preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless FollowThrough Works LLC from any claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the website or service in violation of these Terms or applicable law.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Sacramento County, California, and you consent to personal jurisdiction and venue there.

Changes

We may update these Terms from time to time. Material changes will be reflected by updating the effective date above. Continued use of the site after changes are posted constitutes acceptance.
